Terms of Service

These Terms of Service ("Terms") govern your access to and use of Form Plume, a form-backend service that receives, processes, and forwards submissions from your websites and applications (the "Service"), operated by Form Plume ("we", "us", or "our"). By creating an account or using the Service you agree to these Terms.

1. Acceptance of these Terms

By creating an account, clicking to accept these Terms, or using the Service, you agree to be bound by them and by the policies they reference, including our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for that organization, and references to you include that organization.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and capable of forming a binding contract to use the Service. The Service is not directed to children.

3. Your account and responsibilities

You are responsible for the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current.

You are responsible for:

  • the content and lawfulness of every form you connect to the Service and every submission it receives;
  • obtaining any consents and providing any notices your end users are entitled to under applicable law;
  • configuring spam controls, recipients, and retention settings appropriately for your use;
  • keeping API keys and signing secrets confidential.

4. Acceptable use

Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. We may suspend or terminate accounts that violate it.

5. Plans, billing, and refunds

Paid plans are billed in advance on a recurring basis through our payment provider, which acts as merchant of record for the transaction. Fees, submission limits, and overage behavior are described on our pricing page and may change with notice for future billing periods.

Unless required by law or stated otherwise at the time of purchase, payments are non-refundable. You can cancel at any time; cancellation stops future renewals and your plan remains active until the end of the current period. You are responsible for any taxes other than taxes on our net income.

6. Service availability

We work to keep the Service available and to ingest submissions reliably, but the Service is provided on an as-is and as-available basis. We do not commit to a specific uptime level unless we agree to one in writing. We may modify, suspend, or discontinue features with reasonable notice.

7. Your data and ownership

As between you and us, you own the form submissions and other content you send to the Service ("Customer Data"). You grant us the limited rights needed to host, process, transmit, and back up Customer Data to provide the Service and to comply with law.

For personal data contained in submissions from your end users, you act as the data controller and we act as your processor, as described in our Privacy Policy. A Data Processing Addendum is available on request.

8. Our intellectual property

The Service, including its software, design, and documentation, is owned by us or our licensors and is protected by intellectual property laws. Except for the rights expressly granted here, we reserve all rights.

9. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or other users from harm or abuse. Where practical we will give notice.

On termination, your right to use the Service ends. We will delete or return Customer Data in accordance with our Privacy Policy and retention settings, subject to legal retention obligations.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every submission will be delivered.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to defend and indemnify us against third-party claims arising from your Customer Data, your forms, or your use of the Service in violation of these Terms or applicable law, except to the extent caused by us.

13. Governing law and disputes

These Terms are governed by the laws applicable to the operator's place of establishment, without regard to conflict-of-laws rules. The parties will try to resolve disputes informally first. Mandatory consumer-protection rights in your country of residence are not affected by this clause.

14. Changes to these Terms

We may update these Terms. When we make a material change we will update the version date at the top of this document and ask you to review and accept the updated Terms the next time you sign in. Continued use after the effective date of an update means you accept it.
